These Terms of Service ("Terms") govern your purchase and use of services provided by Feels Personal, ABN 79 546 984 059 ("we", "our", "us"), including software updates, support, and license management for the Feels Personal WordPress plugin.

By purchasing a license or using our services, you agree to these Terms. If you do not agree, please do not purchase or use our services.

1. About These Terms

These Terms govern your relationship with Feels Personal regarding the commercial services we provide.

2. Definitions

  • "Software" means the Feels Personal WordPress plugin.
  • "Services" means the support, software updates, license key activation and management, and any other services we provide to licensed customers.
  • "License" means a paid subscription that entitles you to the Services for a specified number of WordPress sites.
  • "LemonSqueezy" means Lemon Squeezy, LLC, the third-party merchant of record that processes payments, billing, and tax collection on our behalf.
  • "You" / "Customer" means the individual or entity that purchases a License.

3. What Your License Includes

When you purchase a License, you receive ongoing access to:

  • Automatic plugin updates delivered through WordPress
  • Email support from our team
  • License key activation for the number of sites included in your tier
  • Access to tier-gated features within the plugin

These Terms govern your access to those Services.

4. License and Activation

Licenses are available in multiple tiers (currently Silver, Gold, and Platinum), each with different features and site activation limits as described on our pricing page at feelspersonal.io.

  • Each License allows activation on the number of WordPress sites specified for your tier at the time of purchase.
  • Deactivating a site frees that activation slot for use on another site.
  • License keys are for your use only. You are responsible for keeping your license key confidential.
  • We reserve the right to deactivate license keys that are found to be shared publicly or used in violation of these Terms.

5. Subscriptions and Renewal

Licenses are sold as recurring subscriptions that automatically renew at the end of each billing period unless cancelled.

  • All payments are processed by LemonSqueezy as merchant of record. Your payment relationship is with LemonSqueezy, subject to their terms of service.
  • You may cancel your subscription at any time through the LemonSqueezy customer portal. Cancellation takes effect at the end of the current billing period.
  • After cancellation or non-renewal, the plugin code on your site will continue to function, but you will lose access to support, updates, and license key activation.

6. Refunds

We offer a 30-day refund policy on initial purchases. Full details are available in our Refund Policy.

7. Support

We provide email support at support@feelspersonal.io.

  • We use best efforts to respond to support requests within two (2) business days (Australian Eastern time, Monday to Friday, excluding NSW public holidays).
  • Support covers installation, configuration, and troubleshooting of the Feels Personal plugin within standard WordPress environments.
  • Support does not include:
    • Custom development or code modifications
    • Debugging third-party plugin or theme conflicts (beyond reasonable initial troubleshooting)
    • Server configuration or hosting issues
    • Modifications you or a third party have made to the plugin source code

8. Acceptable Use

You agree not to:

  • Circumvent, interfere with, or attempt to disable the license activation system
  • Use automated tools to abuse the license validation API
  • Redistribute your license key to third parties

These restrictions apply to the Services infrastructure only.

8.1 Your Responsibility for Email and Marketing Compliance

Feels Personal is a personalization tool, not a sender, list provider, or email marketing service. You remain solely responsible for compliance with all applicable email, marketing, and data protection laws when using personalized URLs in your campaigns, including but not limited to the CAN-SPAM Act (US), CASL (Canada), GDPR (EU/EEA), the Privacy Act 1988 (Australia), and the Spam Act 2003 (Australia).

This includes obtaining valid consent or another lawful basis for sending marketing communications to your recipients, providing clear unsubscribe mechanisms, and ensuring any data passed through personalized URLs was lawfully collected. We do not monitor, control, or audit how you use personalized URLs in your own campaigns.

9. Consumer Guarantees, Disclaimers, and Limitation of Liability

9.1 Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, and without limiting Section 9.1 for Australian consumers:

  • We are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of the Software or Services.
  • Our total aggregate liability for any claim arising from or related to these Terms or the Services is limited to the amount you paid for your License in the twelve (12) months immediately preceding the event giving rise to the claim.
  • We do not control your hosting environment, server configuration, or third-party plugins and themes. We do not guarantee compatibility with every WordPress configuration.

Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees that cannot be excluded or modified under the Australian Consumer Law or any other applicable law.

10. Third-Party Services

LemonSqueezy acts as the merchant of record for all purchases of Feels Personal licenses. Payment processing, sales tax collection, invoicing, and billing are handled by LemonSqueezy under their own terms of service and privacy policy.

We do not receive or store your credit card or payment details. LemonSqueezy provides us with your name, email address, and order information so we can manage your license and provide support.

The plugin makes server-to-server API calls to LemonSqueezy solely for license activation, validation, and deactivation. No visitor data or website content is transmitted in these calls.

11. Termination

  • By you: You may cancel your subscription at any time and cease using the Services.
  • By us: We may suspend or terminate your License if you materially breach these Terms (for example, systematic abuse of the license system). We will provide reasonable notice before termination where practicable.
  • Effect: Upon termination, your access to support, updates, and license activation ceases. The plugin code on your site will continue to function.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any disputes arising from these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the email address associated with your LemonSqueezy account. Your continued use of the Services after notification constitutes acceptance of the updated Terms.
